font-family: helvetica; color: #3366ff;\">Principales caracter\u00edsticas previas a su reglamentaci\u00f3n.<\/span><!--more--><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Comenzamos por se\u00f1alar <\/span><span style=\"text-decoration: underline;\"><b>algunas<\/b> <b>de las reformas que<\/b> <b>no se aprobaron en la Ley Bases<\/b><span style=\"font-weight: 400;\"> y que estaban <\/span><b>contempladas en el DNU 70\/23<\/b><span style=\"font-weight: 400;\">:<\/span><\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Regulaci\u00f3n de la tasa de inter\u00e9s judicial, aunque la CSJN fall\u00f3 con posterioridad sobre las tasas aplicables.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Posibilidad de pago de sentencias judiciales en 12 cuotas para PYMES<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Derogaci\u00f3n del Estatuto del Viajante de Comercio<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">C\u00f3mputo de importes abonados a trabajadores reingresados.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Modificaci\u00f3n de la jornada laboral<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Por otro lado, la <\/span><span style=\"text-decoration: underline;\"><b>Ley Bases incluye los puntos que detallamos<\/b><\/span><span style=\"font-weight: 400;\"> a continuaci\u00f3n:<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica;\"><b>BLANQUEO LABORAL<\/b><b>\u00a0<\/b><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Plazo: 90 d\u00edas desde la entrada en vigencia de la Ley<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">Se podr\u00e1 regularizar al personal<\/span><\/span><span style=\"font-weight: 400;\"> de manera correcta <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">sin multas, y pagando solo hasta un 30%<\/span><\/span><span style=\"font-weight: 400;\"> del monto adeudado<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Los trabajadores, a su vez, <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">podr\u00e1n computar<\/span><\/span><span style=\"font-weight: 400;\"> un m\u00e1ximo de <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">hasta 60 meses de servicios<\/span><\/span><span style=\"font-weight: 400;\"> con aportes\u00a0<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Habr\u00e1 incentivos para pago al contado y MiPyMes<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Se podr\u00e1n regularizar deudas relacionadas, que <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">se encuentren en instancia administrativa y judicial<\/span><\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: helvetica;\"><b>REFORMA LABORAL<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Desde la vigencia de la Ley Bases <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">se eliminan las multas<\/span><\/span><span style=\"font-weight: 400;\"> de leyes como la 24.013 (ley de Empleo)<\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Esas leyes impon\u00edan multas por registro deficiente, demora en el pago de la indemnizaci\u00f3n, falta de entrega de certificados de trabajo y la penalidad especial por omisi\u00f3n de aportes y contribuciones<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">Simplificaci\u00f3n<\/span><\/span><span style=\"font-weight: 400;\"> de Altas, Bajas, Recibos digitales y DDJJ para <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">empresas de hasta 12 empleados<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: helvetica;\">Digitalizaci\u00f3n de las relaciones ante Organismos<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">No se presume contrato de trabajo<\/span><\/span><span style=\"font-weight: 400;\"> si se emiten Facturas<\/span><span style=\"font-weight: 400;\">, <span style=\"text-decoration: underline;\">bancarizadas<\/span><\/span><span style=\"font-weight: 400;\">, por contrataci\u00f3n de obras, servicios profesionales u oficios<\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">El <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">per\u00edodo de prueba<\/span><\/span><span style=\"font-weight: 400;\"> de extiende <span style=\"text-decoration: underline;\">de 3 a <\/span><\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">6 meses para nuevos empleados<\/span><\/span><span style=\"font-weight: 400;\"> y, seg\u00fan el tama\u00f1o del empleador, podr\u00e1 ampliarse <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">hasta 8 meses o un a\u00f1o<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Participar en <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">bloqueos o tomas<\/span><\/span><span style=\"font-weight: 400;\"> de la empresa ser\u00e1 considerado como injuria laboral grave y <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">causal de despido<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Propone un <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">Fondo o Sistema de Cese Laboral<\/span><\/span><span style=\"font-weight: 400;\"> como alternativa a las indemnizaciones, financiado con un aporte mensual del empleador que no supere el 8% del salario, similar al de UOCRA que deber\u00e1 ser acordado a trav\u00e9s del convenio colectivo de trabajo, por mutuo acuerdo<\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">\u00a0Se establecer\u00e1n <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">indemnizaciones agravadas<\/span><\/span><span style=\"font-weight: 400;\"> en casos de <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">despido por discriminaci\u00f3n<\/span><\/span><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-family: helvetica;\"><span style=\"font-weight: 400;\">Figura de <\/span><span style=\"font-weight: 400;\">\u201c<span style=\"text-decoration: underline;\">Colaborador<\/span>\u201d<\/span><span style=\"font-weight: 400;\">. Para trabajadores <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">aut\u00f3nomos o monotributistas<\/span><\/span><span style=\"font-weight: 400;\">, con emprendimientos productivos, pueden contratar <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">hasta 3 trabajadores <\/span><\/span><span style=\"font-weight: 400;\">independientes, <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">sin relaci\u00f3n laboral<\/span><\/span><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">,<\/span> mientras provean servicios y obras, configurando una relaci\u00f3n aut\u00f3noma.
